Confidentiality

Clients have the right to request sight of, and copies of any and all Client Records I keep, on the provision that I amgiven reasonable notice of such a request. My clients are requested to retain copies of any literature issued in relation to the provision of my services. Where appropriate, I shall issue for my Clientswith appropriate written information, hand-outs or copies of records as part of ouragreed contract, for the benefit of both parties. I will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by me will only be in connection with the provision of agreed ethical services and products.

Exclusions and Limitations

Payment

All major Credit/Debit Cards are acceptable methods of payment. One thing needs to be stated here – whenever you are ordering my services, you are requested to make full payment. I reserve the right to seek recovery of any money remaining unpaid for 30 days from the date of invoice via collection Agencies and/or through the Small Claims Court. It is ideally in the event that the outstanding balance does not exceed INR 50000.00. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

Cancellation Policy

You may cancel any Marketing Service at any time and for any reason after completion of the Initial Term by emailing me(the subject line of email should have “Cancellation Request”) and with a 15-day cancellation notice. Notwithstanding the foregoing, if you wish to cancel any Marketing Service immediately prior to completing the Initial Term, you may do so, provided that you pay mea cancellation fee equal to 50% of any unpaid portion of the Total Long Term Investment (as defined in the Order Form as the clause of“Cancellation Fee”).

Web Master Service and Not Following Payments

Ikeep the right to temporarily or permanently shut down websites of clients who do not follow the payments guidelines for Web Master Services, and are hosting their website with me. 

Termination of Agreements and Refunds Policy

Imay terminate this Agreement upon 30 days prior written notice (the “Notice Period”) if the Customer is in material breach of its obligations hereunder and such breach has not been cured at the conclusion of the Notice Period. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway.

Availability

You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs, and text available through this site. Redistribution or republication of any part of this site or its content is strictly prohibited. This includes framing of similar content by any means without permission and written consent of the vishnutiwari.com. It is my onus to provide you with best uninterrupted and error-free services as per my ability. But that does not guarantee that there will not be any kind of technical glitch at vishnutiwari.com. By using this service you thereby indemnify me, my agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond human control. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

Waiver

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

General

These terms and conditions form part of the Agreement between the Client and myself. Your statutory Consumer Rights are unaffected under any circumstance.

I only create & submit ads in Adwords, Facebook, and LinkedIn. On receiving approval from Google,Facebook, LinkedIn,I manage them on my clients’ behalf.  In case of suspension I will stop their work & client should never force me to restart their work at any condition.”
